Srinagar, 7 Oct. According to police, the Crime Branch Srinagar has filed charges against a teacher and two tax employees for fabricating a backward caste certificate.


“Special Crime Wing (Crime Branch) Srinagar produced charge sheet of case FIR No. 25/2012 before the Hon’ble Court of Anti-Corruption Court Anantnag on 05.10.2023, against three accused persons for their involvement in commission of offences punishable under sections 420,467,468,471,201,120-B RPC, and 5(2) PC Act,” a spokesman said.

Upon receiving a complaint from the former zonal education officer for Kulgam, he claimed that Rashid-Ul-Hassan Gojjar S/o Gh. Hassan R/o Arigatnoo Tehsil was hired as a teacher by the Service Selection Board in accordance with Order No. 2034 of 2007 dated October 17, 2007 under the reserved category of ST.

“The said teacher produced the necessary certificates and documents, including ST, PRC, and DOB certificates, and submitted his joining report on July 11, 2007, in the office of ZEO Kulgam.”

After examining the credentials, it was discovered that the caste of the appointee was “Wagay” on his DOB certificate, which was in conflict with the caste of Gojjar on his PRC and ST certificates.

After receiving this complaint at CBK, a preliminary investigation was launched into the case with PV No. 42/2010 P/S Crime Branch Kashmir.

“During the investigation, it was discovered that the appointee’s true caste is “Wagay,” but that he successfully changed it to “Gojjar” by working with tax authorities. A formal complaint was then filed with P/S Crime Branch Kashmir under FIR No. 25/2012 U/S 420,120-B r/w 5(2) PC Act, and an inquiry was launched, the official said.

The testimony of witnesses was documented throughout the inquiry. The appropriate department provided the necessary records.

The inquiry performed, according to the spokesperson, “has shown that the accused No. 01 (beneficiary), in collusion with the other two accused revenue officers (now retired), has managed to get his caste changed by way of a mutation No. 391/1 at Tehsil Office Kulgam.”

According to court documents, the accused officials “abused their official positions and, in furtherance of criminal conspiracy, prepared and acted on a false and fake mutation, and thereby, for their ulterior motives, issued a fake Schedule Tribe Certificate in favour of the accused beneficiary, who used the same to get himself selected or appointed as a teacher in District Kulgam under ST Category, as such committing offences under U/S 420, 467, 468, 471, 201, 120-B RPC, 5(2) PC Act.”

Finally, based on the evidence, the case was adjudicated proven under Sections 420,467,468,471,120-B RPC and 5(2) of the PC Act against the named accused people.
