Delhi, India (16 August): On Wednesday, Mehbooba Mufti, the former chief minister of Jammu and Kashmir and current president of the PDP, declared that the “idea of India was on trial.” She was referring to the petitions contesting the repeal of Article 370 being heard by the Supreme Court.

Ms. Mufti expressed her delight at the prospect of hearing cases challenging the nullification of Article 370 before the Supreme Court.

“This is an emotional matter for the people of J&K, not just a legal one. It is the lawyers who have given a voice to the voiceless in J&K, and for that we are eternally grateful,” she remarked, as reported by ANI.

According to Ms. Mufti, the ongoing discussions in the SC have “exposed” the ruling party BJP, which has “misused their majority in the Parliament to subvert the Indian Constitution.”

The unique position of the people of J&K has been removed, she claimed. The concept of India itself is being judged now. The Constitution, the courts, and the very foundations of our democratic society are all on trial today…”

In 2019, a Constitution Bench heard many petitions contesting the 2019 Jammu and Kashmir Reorganisation Act, which separated the former State into two Union Territories: Jammu and Kashmir and Ladakh.

The matter is currently being heard by a bench consisting of Chief Justice of India DY Chandrachud and Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai, and Surya Kant.
